WHAT IS A REASONABLE KIWI?

Reasonable Man theory refers to a test whereby a hypothetical person is used as a legal standard, especially to determine if someone acted with negligence. This hypothetical person referred to as the reasonable man (or prudent man) exercises average care, skill, and judgment in conduct that society requires of its members for the protection of their own and of others' interests.

Kiwi is the nickname used internationally for people from New Zealand, as well as being a relatively common self-reference. Unlike many demographic labels, its usage is not considered offensive; rather, it is generally viewed as a symbol of pride and endearment for the people of New Zealand.

A REASONABLE KIWI is thus a person from New Zealand who exercises appropriate care, skill, and judgment in conduct that New Zealand society should require of its members for the protection of their own and of others' interests.
